welcome to d4rkvoids (“d4rkvoids,” “we,” “us,” or “our”). these terms of service, together with our shipping, returns, and privacy terms below (collectively, the “terms”), govern your access to and use of d4rkvoids.com and any purchases made through the site (the “site”).

by visiting or using the site, placing an order, or otherwise purchasing products from us, you agree to be bound by these terms. if you do not agree, do not use the site.

1. eligibility and acceptance of terms

by using this site, you represent and warrant that:

you are at least the age of majority in your state, province, or country of residence, or you are using the site with the involvement and consent of a parent or legal guardian;
you have the legal capacity to enter into a binding agreement; and
you will use the site only in compliance with applicable law and these terms.

we may update or modify these terms at any time by posting the revised version on the site. the updated terms become effective upon posting unless otherwise stated. your continued use of the site after changes are posted constitutes acceptance of those changes.

2. about the site and products

we sell apparel and related merchandise through the site. we reserve the right to modify, discontinue, refuse, limit, or cancel any product, order, service, content, feature, promotion, price, or availability at any time, to the extent permitted by law.

we make reasonable efforts to display product colors, sizing, descriptions, and images as accurately as possible. however, we do not guarantee that product descriptions, images, colors, pricing, inventory, or other content on the site will always be complete, accurate, current, or error-free. minor variations in color, print placement, or garment appearance may occur due to screen settings, manufacturing methods, or production batches and will not be considered defects.

all products are subject to availability. we reserve the right to limit quantities purchased per person, per household, or per order.

3. orders, pricing, and order acceptance

when you place an order, you are making an offer to purchase the selected products subject to these terms. we reserve the right to accept or reject any order for any lawful reason, including suspected fraud, pricing or listing errors, inventory issues, billing issues, or shipping restrictions.

prices are shown in the currency displayed at checkout unless otherwise stated. prices, product availability, promotions, and shipping rates may change without notice.

you agree to provide current, complete, and accurate purchase, payment, and shipping information for all orders. if we believe an order contains inaccurate information or presents fraud, abuse, or unauthorized activity risk, we may cancel or refuse the order.

if a product is listed at an incorrect price or with incorrect information due to a typographical error, technical error, or other issue, we reserve the right to correct the error and cancel or refuse any affected order, including after an order has been submitted, subject to applicable law. if your payment has already been captured for a cancelled order, we will issue a refund for the amount paid.

4. payment and checkout

the site is hosted on shopify, and checkout may be processed through shopify, shopify payments, shop pay, and/or other payment providers made available through our shopify checkout.

by submitting payment information, you represent and warrant that you are authorized to use the payment method provided and that all billing information is true and accurate.

we do not directly store full payment card numbers on our own servers. payment transactions are processed by shopify and/or its authorized payment processing partners in accordance with their applicable terms, privacy practices, and security procedures. your use of shop pay, shopify checkout services, or other payment methods may also be subject to additional terms imposed by those providers.

5. made-to-order items, production times, and worldwide shipping

made-to-order production

many or all d4rkvoids items are made to order. by placing an order, you acknowledge and agree that production may take time before shipment.

unless otherwise stated on the product page or at checkout, orders typically require approximately 3–8 weeks for production and shipment preparation. these timeframes are estimates only, not guarantees, and may vary due to order volume, supply chain delays, carrier delays, holidays, customs processing, or other factors outside our control.

worldwide shipping

we offer worldwide shipping to select destinations that can be serviced by our carriers and shopify shipping configuration. shipping availability may vary by country, region, carrier restrictions, local import rules, or sanctions/compliance restrictions. we reserve the right to decline or cancel orders that cannot be lawfully or practically shipped to the destination provided.

shipping time and delivery estimates

any shipping or delivery dates shown on the site, in order confirmations, or in tracking updates are estimates only and are not guaranteed unless expressly stated otherwise in writing. delays do not entitle a customer to a refund, chargeback, cancellation, or compensation except where required by applicable law.

customs, duties, taxes, and import fees

for international orders, you are solely responsible for any customs duties, import taxes, vat/gst, brokerage fees, handling fees, or other charges imposed by your country, customs authority, or carrier, unless we expressly state at checkout that such charges are included. refusal to pay customs or import charges does not make the order eligible for refund.

incorrect addresses and failed delivery

customers are responsible for providing a complete and accurate shipping address. if an order is returned to us due to an incorrect address, failed delivery, refusal of shipment, or failure to pay import/customs charges, we may charge additional shipping fees before reshipping. if the package is destroyed, abandoned, or otherwise not returned to us, we are not obligated to refund the order.

risk of loss / carrier issues

title to products passes to you to the extent permitted by law when the order is delivered to the shipping carrier or, where applicable law requires otherwise, upon delivery to you. we are not responsible for delays caused by the carrier, customs, weather, or events outside our control.

if a package is marked delivered but you believe it was lost or stolen, you must first contact the carrier and, if applicable, your local authorities. we are not responsible for packages lost, stolen, delayed, or damaged in transit once transferred to the carrier, except to the extent required by law or where shipping insurance was purchased and the claim is approved under the applicable carrier or insurer rules.

6. returns, exchanges, cancellations, and refunds

all sales final / limited exceptions

because our products are custom-made or made to order, all sales are final unless otherwise required by law. we generally do not accept returns, exchanges, or cancellations for:

buyer’s remorse;
incorrect size selection by the customer;
delays that fall within the stated production/shipping window;
refused international deliveries;
customs fees or import charges;
minor variations in color, print placement, stitching, or garment finish that do not materially affect use.

defective or incorrect items

if you receive the wrong item, or an item that is materially defective or damaged upon arrival, contact us at info@d4rkvoids.com within 7 days of delivery and include:

your order number,
a description of the issue, and
clear photo evidence of the item and packaging.

if we determine, in our sole but reasonable discretion, that the item is incorrect, materially defective, or damaged before delivery to you, we may choose to:

replace the item,
issue store credit, or
issue a refund to the original payment method.

we reserve the right to request return of the item before issuing a replacement or refund where reasonably necessary.

nothing in this section limits any non-waivable consumer rights you may have under applicable law.

order cancellations

orders may only be cancelled before production begins, and only if we expressly confirm the cancellation in writing. once production has started, an order generally cannot be cancelled because the item is made to order.

7. promotions, discounts, and gift cards

we may offer discount codes, promotions, gift cards, or other special offers from time to time. unless otherwise stated:

promotions cannot be combined;
promotions have no cash value;
expired promotions will not be honored;
we reserve the right to modify, suspend, or cancel promotions at any time; and
if an order is refunded, the refunded amount will not exceed the amount actually paid.

gift cards, if offered, are subject to any additional terms provided at the time of purchase.

8. intellectual property

all content on the site—including but not limited to text, graphics, logos, artwork, product designs, photographs, audio, video, downloads, branding, and overall site design—is owned by or licensed to d4rkvoids and is protected by copyright, trademark, trade dress, and other intellectual property laws.

you may not reproduce, copy, distribute, display, sell, publish, modify, create derivative works from, exploit, or use any site content or product imagery without our prior written consent.

nothing in these terms grants you any license or ownership rights in any d4rkvoids intellectual property except for the limited right to access and use the site for personal, non-commercial shopping purposes.

9. user conduct and prohibited uses

you agree not to use the site:

for any unlawful, fraudulent, deceptive, or harmful purpose;
to interfere with or disrupt the site, servers, networks, or security features;
to scrape, harvest, crawl, or extract data from the site without authorization;
to upload malicious code, viruses, or harmful material;
to infringe any intellectual property, privacy, publicity, or other rights of any person;
to impersonate another person or submit false information;
to attempt to gain unauthorized access to accounts, systems, or data; or
in any way that could damage, disable, overburden, or impair the site or our operations.

we reserve the right to suspend or terminate access to the site, cancel orders, and take appropriate legal action if we believe these terms have been violated.

10. privacy, data collection, and shopify

what we collect

when you place an order, contact us, sign up for marketing (if offered), or interact with the site, we may collect personal information such as:

billing address,
shipping address,

payment-related transaction information,

other information you voluntarily provide.

how we use personal information

shopify and service providers

your violation of any law or the rights of a third party; or
any content or information you submit to us.

15. termination

we reserve the right, without notice and in our sole discretion, to suspend, restrict, or terminate your access to the site or cancel any order if we believe you have violated these terms, engaged in fraud, abused our policies, or created risk or legal exposure for us.

any provisions of these terms that by their nature should survive termination will survive, including without limitation provisions relating to intellectual property, indemnification, governing law, and dispute resolution.

16. governing law and dispute resolution

these terms and any dispute, claim, or controversy arising out of or relating to the site, any purchase, or these terms shall be governed by and construed in accordance with the laws of the state of california, without regard to conflict of law principles.

17. california consumer notice / international customers

we operate from the united states. if you access the site from outside the united states, you do so at your own risk and are responsible for compliance with local laws to the extent they apply to you.

you understand that your personal information may be processed in the united states and in other countries where shopify or our service providers operate, subject to applicable law and our service providers’ data handling practices.

nothing in these terms is intended to limit any mandatory rights you may have under the consumer protection laws of your country or state of residence that cannot be waived by contract.

18. severability

if any provision of these terms is held to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

19. waiver

our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

20. entire agreement

these terms constitute the entire agreement between you and d4rkvoids regarding your use of the site and any purchase made through the site, and they supersede any prior or contemporaneous communications, understandings, or agreements relating to the same subject matter, except for any additional policies expressly incorporated by reference on the site.
